Analysis: Obama, congress creep closer to 'fiscal cliff'

"Absurd" -- that's the word one top Republican Hill aide used to describe the plan that Treasury Secretary Timothy Geithner presented to GOP leaders yesterday to avoid the fiscal cliff.

And an aide to House Speaker Boehner described the White House's offer as "completely unrealistic" and "a break with reality."

Meanwhile, a top Democratic insider complained to ABC's Jonathan Karl that "the Republicans have taken to screaming at us."

Sources familiar with the phone call Wednesday night between Speaker Boehner and President Obama -- which lasted 30 minutes -- told Karl it was as "unproductive" and "blunt." One source said the president did most of the taking, explaining why he will insist that tax rates go up.

"No substantive progress has been made over the last two weeks," said House Speaker John Boehner at a press conference yesterday. "It's time for the president and Congressional Democrats to tell the American people what spending cuts they're really willing to make."

With few signs of optimism in Washington and just 33 days before the end-of-the-year fiscal cliff deadline, President Obama is taking his show on the road.

ABC's Mary Bruce notes that the president is bypassing the wrangling between both sides and traveling to Hatfield, Pa. today where he will tour a toy manufacturing facility and speak to workers there.

According to the White House, "the President will continue making the case for action by visiting a business that depends on middle class consumers during the holiday season, and could be impacted if taxes go up on 98 percent of Americans at the end of the year."

FROM THE SPEAKER'S OFFICE: Boehner's office gives six reasons why the Obama administration's fiscal cliff offer won't fly:

"1) Twice the Taxes: It's absolutely true that the President ran on a tax plan of raising the top two rates. That's what Americans heard from him. That yields about $800 billion in new tax revenue. He just asked for twice that. 2) Not Even the Votes in His Own Party: The Senate was barely able to pass a bill with $800 billion in new tax revenue a few months ago (51 votes). There is no chance there are votes in the Senate for anything close to $1.6 trillion. 3) Unbalanced: The President also ran on a so-called balanced approach. Apparently his idea of balance is four times as much revenue as spending cuts. 4) No Net Spending Cuts: The spending cuts they are offering (which come later) are wiped out by all the new goodies he's also requesting. (stimulus, UI, payroll, housing, etc). 5) Debt Limit Pipe Dream: Permanently doing away with the debt limit? Come on. Guess what - the debt limit is actually very popular. Raising it to infinity is not. 6) We're Far From Opening Bids: Even as an "opening bid," this offer would be ludicrous. But we're way past that. We had about seven weeks to resolve this. Three of those weeks are gone, and this is what he comes with?"

FROM THE WHITE HOUSE: White House spokesman Josh Earnest: "Right now, the only thing preventing us from reaching a deal that averts the fiscal cliff and avoids a tax hike on 98 percent of Americans is the refusal of Congressional Republicans to ask the very wealthiest individuals to pay higher tax rates. The President has already signed into law over $1 trillion in spending cuts and we remain willing to do tough things to compromise, and it's time for Republicans in Washington to join the chorus of other voices -- from the business community to middle class Americans across the country -- who support a balanced approach that asks more from the wealthiest Americans."

(AP) ? Israel on Friday approved the construction of 3,000 homes in Jewish settlements on Israeli-occupied lands, a government official said, drawing swift condemnation from the Palestinians a day after their successful U.N. recognition bid.

The Palestinians reiterated their refusal to resume negotiations with Israel while building continues. With Israeli Prime Minister Benjamin Netanyahu apparently poised for re-election to another four-year term and insisting that any negotiations begin without preconditions, prospects for an Israeli-Palestinian partition deal appear to be going into deep freeze.

The United Nations voted overwhelmingly to accept a Palestinian state in the West Bank, the Gaza Strip and east Jerusalem as a non-member observer state on Thursday, setting off jubilant celebrations among Palestinians.

Israel fiercely objected to the U.N. upgrade, saying Palestinian statehood could only come from direct negotiations and unilateral moves would harm that prospect. The Palestinians said the U.N. recognition of a Palestinian state in the territories captured by Israel in the 1967 Mideast war was an attempt to salvage a possible peace deal.

Palestinian President Mahmoud Abbas has refused to negotiate with Israel while settlement construction continues, saying Israel's settlement expansion on war-won land was making a partition deal increasingly difficult.

Palestinian negotiator Saeb Erekat condemned Israel's announcement, saying it was "defying the whole international community and insisting on destroying the two-state solution." He said the Palestinian leadership is studying its options.

Abbas spokesman Nabil Abu Rdeneh also insisted earlier Friday the Palestinian position hadn't changed, saying settlement building "is not just illegal, it's against the resolution."

More than 500,000 Israelis have moved to the West Bank and east Jerusalem since 1967. Israel unilaterally withdrew its soldiers and settlers from Gaza in 2005, but continues to partially control access. The Islamic militant group Hamas seized control of the territory from Abbas' control in 2007 and recently gained popularity after holding its own following an eight-day Israeli military offensive aimed at stopping rocket fire.

The Israeli official, who spoke on condition of anonymity because he was not authorized to discuss the sensitive issue publicly, said Israel decided to build 3,000 apartments for Jews in the West Bank and east Jerusalem. He said the government also decided to begin preparations for construction in other areas of the West Bank, including the so-called E-1 corridor that connects Jerusalem with the settlement bloc of Maaleh Adumim.

Construction there would pose a major obstacle for Palestinian statehood by cutting off east Jerusalem from the West Bank. Successive U.S. administrations have pressured Israel not to build in E-1 where a development plan calls for at least 3,500 homes.

Danny Seidemann, a lawyer for Ir Amim, an Israeli group that supports coexistence in Jerusalem, said construction did not appear imminent and the Israeli announcement contained "quite a lot of drama."

"There's an element of sticking it to the Palestinians," he said, adding that plans in E-1 were not only a slap to the Palestinians but to the Americans who oppose them too. "E-1 is the Judgment Day weapon," he said of the strategic impact of construction in that area.

Yesh Din, an Israeli rights group, called the Israeli decision "collective punishment" and called on Israel to retract its move.

"Israel should have understood by now that such behavior ... will no longer be tolerated by the international community," the group's executive director, Haim Erlich said.

Earlier this month, Israel said it was pushing forward construction of 1,200 new homes in Jewish settlements, in an apparent warning to the Palestinians to rethink their U.N. plan. Israel fears the Palestinians will use their upgraded status to confront Israel in international bodies and pressure it to make concessions.

Former Foreign Minister Tzipi Livni, the one-time chief negotiator with the Palestinians, also slammed the decision.

"The decision at the U.N. on a Palestinian state is bad for Israel and so is Netanyahu's response," said Livni, who this week formed a new party to compete in Jan. 22 parliamentary elections. "The decision to build thousands of housing units as punishment to the Palestinians only punishes Israel ... the unnecessary statement only isolates Israel further."

In the U.N., only nine states opposed the Palestinian bid, including Israel and the United States, while 138 supported it.

The vote granted Abbas an overwhelming international endorsement for his key position: establishment of a Palestinian state in the West Bank, Gaza Strip and east Jerusalem. Netanyahu opposes a full pullback to the 1967 lines.

The Palestinians turned to the U.N. after two decades of on-again, off-again talks.

Netanyahu dismissed the U.N. vote as meaningless and accused Abbas of delivering a "defamatory and venomous" U.N. speech "full of mendacious propaganda" against Israel.

Egypt crisis raises fears of 'second revolution'

CAIRO (AP) ? Faced with an unprecedented strike by the courts and massive opposition protests, Egypt's Islamist president is not backing down in the showdown over decrees granting him near-absolute powers.

Activists warn that his actions threaten a "second revolution," but Mohammed Morsi faces a different situation than his ousted predecessor, Hosni Mubarak: He was democratically elected and enjoys the support of the nation's most powerful political movement.

Already, Morsi is rushing the work of an Islamist-dominated constitutional assembly at the heart of the power struggle, with a draft of the charter expected as early as Thursday, despite a walkout by liberal and Christian members that has raised questions about the panel's legitimacy.

The next step would be for Morsi to call a nationwide referendum on the document. If adopted, parliamentary elections would be held by the spring.

Wednesday brought a last-minute scramble to seize the momentum over Egypt's political transition. Morsi's camp announced that his Muslim Brotherhood and other Islamists will stage a massive rally in Cairo's Tahrir Square, the plaza where more than 200,000 opposition supporters gathered a day earlier.

The Islamists' choice of the square for Saturday's rally raises the possibility of clashes. Several hundred Morsi opponents are camped out there, and another group is fighting the police on a nearby street.

"It is tantamount to a declaration of war," said liberal politician Mustafa al-Naggar, speaking on the private Al-Tahrir TV station.

Morsi remains adamant that his decrees, which place him above oversight of any kind, including by the courts, are in the interest of the nation's transition to democratic rule.

Backing down may not be an option for the 60-year-old U.S.-educated engineer.

Doing so would significantly weaken him and the Brotherhood at a time when their image has been battered by widespread charges that they are too preoccupied with tightening their grip on power to effectively tackle the country's many pressing problems.

Morsi's pride is also a key factor in a country where most people look to their leader as an invincible figure.

He may not be ready to stomach another public humiliation after backing down twice since taking office in June. His attempt to reinstate parliament's Islamist-dominated lower chamber after it was disbanded in July by the Supreme Constitutional Court was overturned by that same court. Last month, Morsi was forced to reinstate the country's top prosecutor just days after firing him when the judiciary ruled it was not within his powers to do so.

Among Morsi's first acts after seizing near-absolute powers last week was to fire the prosecutor again.

Unlike last year's anti-Mubarak uprising, calls for Morsi's ouster have so far been restricted to zealous chants by protesters, with the opposition focusing its campaign on demands that he rescind his decrees, disband the constitutional panel and replace it with a more inclusive one, and fire the Cabinet of Prime Minister Hesham Kandil.

"There is no practical means for Morsi's ouster short of a coup, which is very, very unlikely," said Augustus Richard Norton, a Middle East expert from Boston University.

Still, the opposition, whose main figures played a key role in the anti-Mubarak uprising, may be tempted to try to force Morsi from office if they continue to draw massive crowds like Tuesday's rally, which rivaled some of the biggest anti-Mubarak demonstrations. They will also likely take advantage of the growing popular discontent with Morsi's government and the fragility of his mandate ? he won just 51 percent of the vote in a presidential election fought against Mubarak's last prime minister.

With the country still reeling from the aftershocks of the 18-day uprising that toppled Mubarak's 29-year regime, activists and analysts warn that any escalation carries the risk of a second, and possibly bloody, revolution ? pitting Islamists against non-Islamists, including liberals, women and minority Christians.

Ominous signs abound. Anti-Morsi crowds have attacked at least a dozen offices belonging to the Brotherhood across the nation since last week. Clashes between the two sides have left at least two dead and hundreds wounded.

The violence and polarization has led to warnings from some newspaper columnists and the public at large of the potential for "civil war."

"As opposed to seeking face-saving compromises, (escalation by Morsi) would indicate starkly that Egypt's leaders have increasingly come to understand the current moment in zero-sum terms," said Michael W. Hanna, an Egypt expert from the New York-based Century Foundation.

"Beyond the political dangers it poses, the move will increase the risks that the contests for power will spill over into the streets, with civil strife a real possibility."

While potentially destabilizing, Morsi's tug-of-war with the liberal opposition pales in comparison to his battle with the powerful judiciary, which considers the president's decrees an unprecedented assault on its authority.

On Wednesday, judges of the nation's highest appeals court and its lower sister court went on strike to protest the decrees, joining hundreds of other judges who have not worked since Sunday.

The Supreme Constitutional Court, which is to rule Sunday on the legality of the constitutional panel and parliament's upper chamber ? both dominated by Morsi's Brotherhood and other Islamists ? admonished the president for accusing it of trying to bring down his government.

The loss of the judiciary's goodwill could prove costly for Morsi.

Already, the judges are warning that, unless their demands are met, they will not assume their traditional role of supervising a referendum on a new constitution or the parliamentary elections that would follow. Without them, the legitimacy of any vote would be in question.

"This is the highest form of protest," said Nasser Amin, head of the Arab Center for the Independence of the Judiciary and the Legal Profession. "The judges felt that the constitutional declaration has taken away from them the dearest and most important mandates" ? oversight of government decisions.

London Markets: London stocks weaken; banks, resources off

LONDON (MarketWatch) ? U.K. stocks ended a volatile session on an upbeat note on Wednesday, as rising shares of Vodafone Group PLC provided support, although banks and mining firms on the decline added pressure.

The FTSE 100 index /quotes/zigman/3173262 UK:UKX +0.06% ?inched 0.1% higher to close at 5,803.28, after swinging between small gains and losses.

Resolution Ltd. shares /quotes/zigman/602765 UK:RSL -0.47% ?slipped 0.6%, after UBS cut the insurer to neutral from buy. The analysts said they expect the firm to miss its 2013 targets.

Charged exec cooperating in W.Va. mine blast probe

(AP) ? Federal prosecutors investigating the West Virginia mine explosion that killed 29 men widened their net Wednesday, filing criminal charges against a longtime Massey Energy executive who worked closely with former CEO Don Blankenship ? a move signaling where their sights may be ultimately set.

The cooperation of David Craig Hughart is a sign that authorities may be gathering evidence to target officials further up the Massey hierarchy. Some victims' families hold Blankenship personally responsible for the worst U.S. mining disaster in four decades, though prosecutors have declined to say who else could face charges in the wide-ranging and continuing probe.

Several former federal prosecutors say it wouldn't be easy to prosecute Blankenship, and it would require more than just damning testimony from witnesses who may have their own agendas.

Corporations like Massey, since bought out by Virginia-based Alpha Natural Resources, are typically are structured to shield their leaders from liability, the experts say. To reach the top, investigators would most likely need hard evidence to match witnesses' words.

Either that, says former U.S. Attorney Kendall Coffey of Miami, or they'll need multiple witnesses.

"If the star witness has a supporting cast," he said, "it can be a compelling basis for conviction."

Hughart, former president of a Massey subsidiary that controlled White Buck Coal Co., worked alongside Blankenship for at least 15 years and was named in a federal information filed Wednesday in U.S. District Court in Beckley. He is cooperating with prosecutors, and U.S. Attorney Booth Goodwin said Hughart is prepared to plead guilty to two conspiracy charges that carry the possibility of six years in prison.

Hughart's phone has been disconnected, and his attorney didn't immediately comment.

Although Upper Big Branch is never directly mentioned in the case against Hughart, Goodwin said the charges stem from the investigation of the April 2010 explosion. And the nature of the allegations parallels charges brought against those who were directly involved with UBB.

Prosecutors say Hughart worked with unnamed co-conspirators to ensure miners at White Buck and other, unidentified Massey-owned operations received advance warning about surprise federal inspections many times between 2000 and March 2010.

Those illegal warnings gave workers time to conceal life-threatening violations that could have led to citations, fines and costly shutdowns, authorities say.

Hughart faces two charges: felony conspiracy to defraud the government by impeding the Mine Safety and Health Administration, and misdemeanor conspiracy to violate mandatory health and safety standards.

Goodwin wouldn't say who else might be charged or when, but that his investigators are "trying to push forward as quickly as we can."

Hughart has been president of at least 10 Massey subsidiaries throughout his career, positions that would have required the consent of a CEO whose micromanagement is well documented.

At Upper Big Branch, for example, Blankenship demanded production reports every 30 minutes.

And last year, Blankenship acknowledged during a deposition for an unrelated lawsuit that his employees had sometimes found cans of Dad's root beer on their desks: Dad's, he told the attorney questioning him, stood for "Do as Don says."

Neither Blankenship, who retired about eight months after the UBB disaster, nor one of his attorneys responded to an email seeking comment.

Four investigations have concluded that Massey concealed problems at UBB through an elaborate scheme that included sanitized safety-inspection books and an advance-warning system.

Clay Mullins, who lost brother Rex in the explosion, doesn't believe it will be that hard to prove that Blankenship personally maintained a corporate culture that put no value on workers or safety.

"I think all Massey operations ran just the way UBB did," Mullins said. "They all had advance warning. They all tried to hide and cover up as much as they could. They tried to conceal and deceive and deny. That was Massey's mentality. That was how they handled things."

The United Mine Workers of America, which accused Massey of "industrial homicide," has demanded that Blankenship and 17 other Massey managers who refused to talk to investigators be compelled to testify publicly or cited for contempt. It says those responsible for the disaster must be brought to justice.

But David Weinstein, a former assistant U.S. attorney in Miami who now heads the white-collar litigation practice of a private law firm, said corroboration would be critical to prosecuting Blankenship.

"They are going to need documents," he said. "The real linchpin of their prosecution is being able to prove the CEO or some other officer or director actively participated in what was going on."

Absent direct proof, Weinstein said, prosecutors would have to demonstrate "willful blindness" to matters of safety.

After a 2006 fire that killed two men at a different Massey operation, a memo surfaced that could help prosecutors make that part of the case. In it, Blankenship told workers at the mine that if their bosses asked them to build roof supports or perform similar safety-related tasks, "ignore them and run coal."

"This memo is necessary only because we seem not to understand that the coal pays the bills," he wrote.

Massey settled that lawsuit for undisclosed terms, and its Aracoma Coal subsidiary paid $4.2 million in civil and criminal penalties.

Bruce Stanley, the Pittsburgh attorney who handled that lawsuit and others against Massey, said no managers could act without Blankenship's direction.

"I cannot imagine that anybody at Hughart's pay rank could engage in any of the activities that he's accused of without Don Blankenship's permission and blessing," Stanley said.

During the Aracoma investigation, memos made clear that Blankenship paid particular attention to mines that were falling short of budget projections, Stanley said. The day of the fire, he called Aracoma's then-president, wondering why a section crew wasn't working.

"Indeed he was super micromanaging all of these mines," Stanley said. "At the section level and on a daily basis."

Hughart is the third person to face serious criminal charges in connection with Upper Big Branch.

Former UBB superintendent Gary May is also cooperating with prosecutors. He pleaded guilty to a federal conspiracy charge for his actions at the mine and is set to be sentenced in January.

Former Massey security chief Hughie Elbert Stover, meanwhile, is appealing his conviction last fall on charges he lied to investigators and ordered a subordinate to destroy documents.

He was sentenced to three years behind bars ? one of the stiffest punishments ever handed down in a mine safety case ? but has been free pending appeal.? Witnesses testified that Stover instructed mine guards to send radio alerts whenever inspectors entered the property. He's denied any wrongdoing.

The explosion at Upper Big Branch was sparked by worn teeth on a cutting machine, and fueled by methane and coal dust. It was allowed to propagate by clogged and broken water sprayers. The force of the blast traveled miles of underground corridors, killing men instantly.

Goodwin's office negotiated a $210 million agreement with Alpha to settle past violations at UBB and other Massey mines, protecting the company from criminal prosecution.

But individuals remain on the hook.?

Jeffrey Sloman, a former U.S. attorney in Miami, said criminal prosecutions of big-company CEOs are "relatively rare, but it happens from time to time."

"You see it on Wall Street," he said, "with New York going after financial crimes cases pretty aggressively."

Gary Quarles, who lost his son Gary Wayne at Upper Big Branch, just wants Blankenship to face criminal charges and be held accountable.

"Everybody thinks he's above the law," he said. "I want at least something filed against him, to show him you can be had. It doesn't matter what he's charged with, just something. ... Even Martha Stewart went to jail. "
